Terms of Service
Effective Date: October 30, 2026
1. Agreement to These Terms
These Terms of Service ("Terms") form a binding agreement between you and BioSocial LLC ("BioSocial," "we," "us," or "our") and govern your access to and use of the BioSocial website, mobile application(s), and related services (collectively, the "Service"). By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
Certain features of the Service involve the collection, display, and community sharing of health and biomarker information. Please read Section 6 (Your Content and the "Shared by Default" Data Model) carefully before you upload any health data.
2. Eligibility
You must be at least 18 years old and capable of forming a binding contract to create an account or use the Service. BioSocial is not directed to, and does not knowingly collect personal information from, anyone under 18. If we learn that an account belongs to someone under 18, we will terminate the account and delete associated data as described in our Privacy Policy.
By using the Service you represent that: (a) you are 18 or older; (b) any biomarker, lab, or health information you upload is your own or you have the legal right to upload it; and (c) your use of the Service complies with all applicable laws.
3. Description of the Service
BioSocial is a social platform that helps users track health practices (e.g., diet, exercise, supplements, sleep protocols, and similar behaviors), connect biomarker data (from lab panels, connected devices, and manual uploads), and compare their results with a community of users engaged in similar practices. The Service includes, among other features:
Practice logging — recording health practices you are engaged in.
Biomarker and bloodwork tracking — connecting lab results (including via third-party lab and lab-booking partners such as Quest Diagnostics, accessed through Apple Health) and device data (e.g., Apple Health, Oura, Whoop) or manually uploading results.
AI-generated "Before → Practice → After" summaries — automated narratives and benchmarking generated by our systems from your biomarker data and the data of other consenting users.
Community feed, public profile pages, and Q&A — social and discussion features, some of which may be publicly visible and indexed by search engines.
We may add, change, or remove features at any time. We may also introduce paid features in the future; if we do, we will update these Terms and provide notice before any charges apply.
4. Not Medical Advice; No Doctor-Patient Relationship
THE SERVICE IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. Content on the Service — including AI-generated narratives, benchmarking statistics, community posts, and any correlation between a practice and a biomarker — reflects observed associations in self-reported, uncontrolled user data, not clinical proof of cause and effect. Individual results vary, and confounding factors (diet, sleep, concurrent practices, lab variability, and regression to the mean, among others) are not controlled for.
Nothing on the Service creates a doctor-patient or other clinical relationship. Always consult a qualified physician or other licensed healthcare provider before starting, stopping, or changing any medication, supplement, diet, or exercise program, and before making any decision based on information from the Service. If you believe you are experiencing a medical emergency, call emergency services immediately — do not rely on the Service.
5. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. You agree to provide accurate registration information and to keep it up to date.
6. Your Content and the "Shared by Default" Data Model
BioSocial's community benchmarking only works because members share real data. Unlike wearable and lab apps that default to fully private data, BioSocial's community and benchmarking features are built on data that is shared by default within the community, subject to the identity and visibility controls described in our Privacy Policy (for example, choosing a display name instead of your real name, and controls over which fields appear on your public profile).
By logging a practice or uploading biomarker/lab data, you agree that de-identified or pseudonymous versions of that data may be used to generate community benchmarks, percentile comparisons, and AI-generated Before → Practice → After narratives shown to you and, depending on your settings, to other users.
You choose who can view your individual health profile (Public, Approved Connections, or Private) and the display name shown, as described in the Privacy Policy. Under Approved Connections, you decide follower by follower who may view your health profile, whether or not they have requested access, and you may remove access at any time. Your visibility choice does not affect community aggregates: the data of all members, including those who choose Approved Connections or Private, contributes to de-identified community aggregates and the contributor counts displayed with them. This data-sharing model for benchmarking is a core, non-optional part of how the Service functions.
You retain ownership of the content and data you submit. You grant BioSocial a worldwide, royalty-free, sublicensable license to host, store, reproduce, analyze (including via AI/ML systems), display, and distribute your content and data as necessary to operate, improve, and promote the Service, including generating aggregated and de-identified insights as described in Section 12.
You represent that any bloodwork, lab result, or device data you upload is accurate to the best of your knowledge and belongs to you.
This is a directional summary of the data-sharing model; the definitive, controlling description of what is collected, how it is shared, and what choices you have is in the Privacy Policy, including the Consumer Health Data section required under state law.
7. Public Profiles, SEO-Indexed Pages, and Community Posts
Some parts of the Service — including public profile pages, community posts, and Q&A content — may be indexed by search engines and visible to people who are not registered users. Do not post anything you do not want to be publicly discoverable. You are solely responsible for the content of your posts and comments.
Community posts, comments, replies, and reactions are always public, regardless of your health profile visibility setting. Choosing Approved Connections or Private limits who may view your individual health profile only; it does not make your community activity private.
Community aggregates are displayed only when they meet a minimum number of contributors set by BioSocial. During the prototype stage this minimum is one contributor, so an aggregate may reflect a single member's data. We may change this minimum at any time. Notices about health profile access requests and decisions are delivered in the app; email notifications for these events are not currently provided.
Community content you post (including questions, comments, and replies) may be displayed alongside AI-generated summaries drawn from the broader community's data, and may be used to generate new, separately indexed pages (for example, a post/question page) as part of the Service's content structure.
8. Device, Lab, and Third-Party Platform Connections
The Service allows you to connect third-party platforms and services, which may include Apple Health, wearable device makers (e.g., Oura, Whoop), and direct-to-consumer lab or lab-booking services (e.g., Quest Diagnostics, Function Health, Superpower). When you connect a third-party account:
You authorize BioSocial to access and import the data you approve through that platform's own permission flow.
Your use of the third-party platform remains governed by that platform's own terms and privacy policy, which we do not control.
We are not responsible for the accuracy, availability, or practices of third-party platforms, and connectivity may be interrupted by changes those platforms make.
Some connections may generate referral or affiliate compensation to BioSocial, as described in Section 13. This does not change the accuracy or independence of any biomarker data displayed.
9. AI-Generated Content and Benchmarking
BioSocial uses automated and AI-based systems to normalize uploaded data, generate Before → Practice → After narratives, and produce community benchmarks and percentile comparisons. These outputs are generated, not human-authored, and are provided "as is" for informational purposes. They may contain errors, may be based on limited sample sizes (particularly for less common practices), and should not be treated as validated or peer-reviewed research.
10. Acceptable Use
You agree not to:
Upload health data belonging to another person without their authorization.
Post false, misleading, or fraudulent biomarker data, lab results, or practice logs.
Impersonate another person or misrepresent your affiliation with any person or entity.
Harass, threaten, or abuse other users, or post content that is unlawful, defamatory, or infringing.
Scrape, reverse-engineer, or use automated means to extract data from the Service outside of any API we may provide.
Use the Service to provide medical advice or diagnosis to others, or to practice medicine without a license.
Interfere with the security or normal operation of the Service.
We may remove content, suspend, or terminate accounts that violate this section, in our discretion.
11. Intellectual Property
The Service, including its software, design, taxonomy, trademarks, and BioSocial-authored content, is owned by BioSocial or its licensors and is protected by intellectual property laws. Except for the rights granted in Section 6, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms.
12. Aggregate/De-Identified Data, Research, and Data Licensing
BioSocial may compile, analyze, and license aggregate, de-identified insights derived from community data — for example, to life sciences companies, health systems, researchers, or payers studying which practices are associated with which biomarker outcomes. We will not license or sell data that identifies you as an individual. This program is a planned, future revenue line and will be subject to a de-identification and statistical-rigor standard defined before it launches commercially; the Privacy Policy describes your rights and choices with respect to this use.
13. Sponsorships, Referral Links & Affiliate Relationships
BioSocial may display sponsored content on practice pages and other areas of the Service, and may earn referral or affiliate compensation when you sign up for or purchase a third-party device, lab test, or service through a link on the Service. Sponsored placements will be identified as such. Sponsorship or affiliate relationships do not influence the underlying biomarker data or community benchmarks displayed.
14. No Fees Currently Charged
As of the date of these Terms, the Service is free for individual users; BioSocial's revenue comes from sponsorships, referral/affiliate arrangements, and (in the future) data licensing, not user subscriptions. If we introduce paid features, we will amend these Terms and obtain your agreement before charging you.
15. Term, Suspension & Termination
You may download a portable copy of the personal and health data currently stored in your account through Download my data in Settings. You may permanently delete your account through Delete account in Settings, followed by an explicit confirmation, or contact us if you cannot access your account. Save your data copy before deletion if you want to keep it. Deletion removes your account, identifiable health records, uploaded files and associated community content from our active systems and cannot be undone. It does not delete records held by Apple Health or other third-party services, or copies others have made. Backup, legal-retention and irreversibly de-identified aggregate exceptions are described in the Privacy Policy. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users. Section 6's license may continue only as applicable to already irreversibly aggregated and de-identified data, as described in the Privacy Policy.
16. Disclaimers of Warranties
THE SERVICE, INCLUDING ALL CONTENT, BENCHMARKS, AND AI-GENERATED OUTPUTS, IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. WE DO NOT WARRANT THE ACCURACY OF ANY BIOMARKER DATA, THIRD-PARTY DEVICE OR LAB DATA, OR AI-GENERATED CONTENT.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIOSOCIAL AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, HEALTH OUTCOMES, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID BIOSOCIAL IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
18. Indemnification
You agree to indemnify and hold BioSocial harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your content, or your misuse of the Service.
19. Dispute Resolution; Arbitration Agreement; Class Action Waiver
Except for claims that may be brought in small claims court, and except for claims for injunctive relief relating to intellectual property or misuse of data, you and BioSocial agree to resolve any dispute arising out of or relating to these Terms or the Service through binding individual arbitration, rather than in court. You and BioSocial each waive the right to a jury trial and to participate in a class, collective, or representative action. Arbitration will be administered by a recognized arbitration provider under its rules then in effect, and will take place in the county where BioSocial is headquartered unless the parties agree otherwise. You may opt out of this arbitration agreement by sending written notice to BioSocial within 30 days of first agreeing to these Terms.
20. Governing Law & Venue
These Terms will be governed by the laws of the State of Delaware, without regard to conflict-of-laws principles, except where mandatory consumer-protection or health-data law of a user's home state or country requires otherwise. Subject to Section 19, the state and federal courts located in Delaware will have exclusive jurisdiction over any dispute not subject to arbitration.
21. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms with a new "Last Updated" date and, for material changes — particularly any change affecting how health data is shared, used for benchmarking, or licensed — provide advance notice and, where required by law, obtain renewed consent before the change applies to previously collected data. Continued use of the Service after changes take effect constitutes acceptance, except where opt-in consent is legally required.
22. Miscellaneous
These Terms, together with the Privacy Policy, constitute the entire agreement between you and BioSocial regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
